1. What these terms cover

These Terms of Service form a contract between you and SpeakFeed LLC ("SpeakFeed" "we" "our" "us"). They govern your access to and use of our websites, mobile apps, and related services (collectively the "Services").

By creating an account, starting a trial, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. Who can use SpeakFeed

• You must be at least 18 years old and legally able to enter into contracts.
• If you use SpeakFeed on behalf of an organization, you represent that you have authority to bind that organization.
• You are responsible for all activity under your account and for safeguarding your credentials.

3. Key definitions

• User Content: Any text, images, videos, feedback, or other materials you or your team submit or upload.
• Audience Data: Responses and feedback submitted by attendees.
• Public Profile: The portion of your account you choose to share publicly.
• Organizer Summary: A private summary generated by the Services for event organizers.

4. Your content and your rights

You own your User Content and Audience Data. By using the Services, you grant SpeakFeed a worldwide, non-exclusive, royalty-free license to host, store, process, adapt, and display that content solely to operate and improve the Services.

You are responsible for ensuring you have all necessary rights and permissions to upload or import data and materials. Do not upload content you are not authorized to share.

5. Privacy and data roles

Our Privacy Policy explains how we collect and use personal information.

• For Audience Data, you are the controller, and SpeakFeed acts as a processor.
• For account, billing, and support data, SpeakFeed is the controller.

We may use aggregated or de-identified data to operate and improve the Services but will never attempt to re-identify it.

6. Acceptable use

You agree not to:

• break the law, infringe on others' rights, or violate privacy;
• upload unlawful, harassing, or misleading content;
• collect data from children or without consent;
• attempt to reverse engineer or disrupt the Services;
• use SpeakFeed to send spam or unauthorized messages.

We may suspend or terminate your account if you violate these terms.

7. Subscriptions, trials, and billing

• Paid plans renew automatically unless canceled.
• Cancel anytime in your account settings; cancellation takes effect at the end of the billing cycle.
• Fees are non-refundable except where required by law.
• SpeakFeed may adjust pricing with prior notice.
• Applicable taxes will be added to invoices.
• Founders Club members retain lifetime discounts while subscriptions remain active.

8. Marketplace and introductions

If you use any marketplace or discovery features, you acknowledge that SpeakFeed is not a talent agency and does not guarantee bookings or specific results.

9. Mobile apps and third-party services

Use of our mobile apps is also governed by each app store's terms. We are not responsible for third-party services linked through SpeakFeed.

10. Intellectual property

SpeakFeed, our logos, and all related content, software, and trademarks belong to SpeakFeed LLC or its licensors. You may not copy or modify them without permission.

11. Feedback

If you share ideas or suggestions, you agree we may use them freely without compensation.

12. Beta or preview features

Beta features may change or be discontinued at any time and are provided "as is."

13. Disclaimers

The Services are provided as is and as available without warranties of any kind. SpeakFeed disclaims all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of liability

To the fullest extent permitted by law, SpeakFeed and its affiliates are not liable for indirect, incidental, special, or consequential damages. Total liability for any claim will not exceed the greater of (a) amounts you paid to SpeakFeed in the past 12 months or (b) $100.

15. Indemnification

You agree to defend, indemnify, and hold harmless SpeakFeed, its employees, and affiliates from any claim arising out of your use of the Services or violation of these Terms.

16. Termination

You may stop using SpeakFeed at any time. We may suspend or terminate your access if you breach these Terms, fail to pay fees, or pose a legal or security risk. Sections that should survive termination will continue to apply.

17. Changes to these Terms

We may update these Terms from time to time. We will post updates and notify you of material changes. Continued use means you accept the updated Terms.

18. Governing law and disputes

These Terms are governed by the laws of the State of Washington, USA.

You and SpeakFeed agree to submit to the exclusive jurisdiction of the state and federal courts located in Seattle, Washington for all disputes.
